Public holidays, substitute holidays and annual leave in Korea for 2026: what the holiday regulation and the Labor Standards Act say
Last checked: 21 October 2026 · compared against 6 official sources opened that day
Korea's public holidays are set by the Regulation on Holidays of Government Offices, and the Labor Standards Act turns them into paid holidays for employees. A 2026 amendment added Labor Day and Constitution Day and widened substitute holidays. We read the current regulation and its amendment reasons, the National Holidays Act, the Labor Day Act and the Labor Standards Act and Decree through the Korean Law Information Center API on 21 October 2026, and checked the dates against the Korea Astronomy and Space Science Institute's calendar data.
The holidays
Article 2 of the regulation lists Sundays; the national holidays (Independence Movement Day 1 March, Constitution Day 17 July, Liberation Day 15 August, National Foundation Day 3 October and Hangeul Day 9 October); 1 January; the three-day Lunar New Year (Seollal); Buddha's Birthday; Labor Day (1 May); Children's Day (5 May); Memorial Day (6 June); the three-day Chuseok; Christmas; election days for regular national and local elections; and other days the government designates. Temporary holidays need a Cabinet deliberation (Article 4).
The 2026 amendment
The amendment promulgated on 30 April 2026 explains that, after the Public Holidays Act was revised, Constitution Day and Labor Day were added to the government holidays, with substitute days when they fall on a weekend or another holiday. It took effect on 1 May 2026, and the national holiday part, which brings in Constitution Day, on 11 May 2026. A separate Labor Day Act also makes 1 May a paid holiday under the Labor Standards Act.
Substitute holidays
Under Article 3, the next non-holiday becomes a substitute holiday when a national holiday, Buddha's Birthday, Labor Day, Children's Day or Christmas falls on a Saturday or Sunday; when Seollal or Chuseok falls on a Sunday (not a Saturday); or when any of these falls on a weekday that is already another holiday. New Year's Day and Memorial Day are not on the list, so they get no substitute.
The 2026 calendar
Combining the astronomy institute's 2026 data with the amended regulation: 1 January (Thu); Seollal 16 to 18 February (Mon to Wed); 1 March (Sun) with a substitute on 2 March; Labor Day 1 May (Fri); Children's Day 5 May (Tue); Buddha's Birthday 24 May (Sun) with a substitute on 25 May; the local election on 3 June (Wed); Memorial Day 6 June (Sat, no substitute); Constitution Day 17 July (Fri); Liberation Day 15 August (Sat) with a substitute on 17 August; Chuseok 24 to 26 September (Thu to Sat, no substitute because it overlaps a Saturday only); National Foundation Day 3 October (Sat) with a substitute on 5 October; Hangeul Day 9 October (Fri); and Christmas 25 December (Fri).
The institute's page says its data is not the official almanac and predates the amendment, listing Labor Day only as a commemorative day; we added Labor Day and Constitution Day from the amended regulation. Temporary holidays are not included.
Are holidays paid for employees?
Article 55(2) of the Labor Standards Act requires employers to give the holidays set by decree as paid holidays, and Article 30(2) of the Decree defines them as the regulation's holidays (except Sundays) plus substitute holidays. So at workplaces with five or more regular employees, all the days above are paid holidays. A written agreement with the employee representative can swap a holiday for another working day. Separately, employers must give at least one paid weekly rest day on average to employees who worked all their scheduled days that week.
Workplaces with four or fewer employees
Article 11 applies only selected provisions to workplaces with four or fewer regular employees. Annex 1 of the Decree lists, from the working hours chapter, only Article 54 (breaks), Article 55(1) (weekly rest day) and Article 63. Paid public holidays, overtime and holiday premiums and annual leave therefore do not apply there. Labor Day rests on its own act, and we could not confirm the ministry's view on whether it is paid at such small workplaces; ask the 1350 helpline.
Working on a holiday
At workplaces with five or more employees, holiday work earns at least 50% extra for the first eight hours and 100% extra beyond eight hours (Article 56(2)), and night work between 10 pm and 6 am earns a further 50%.
Annual leave
Article 60 gives 15 days of paid leave after a year with at least 80% attendance. With under a year of service, or under 80% attendance, you earn one day per month of full attendance. From the third year, one extra day is added for every two years beyond the first, up to 25 days. Time off for work injuries, maternity leave and parental leave counts as attendance. Leave is taken when you ask for it, though the employer may change the timing if it would seriously disrupt the business.
Unused leave
Leave lapses after a year unless the employer prevented you from using it. Under Article 61, if the employer followed the formal process, including a written notice of your remaining days within ten days of the point six months before expiry, and you still did not use them, the employer owes no compensation; answer such notices with your chosen dates within ten days. Article 62 lets the employer, by written agreement with the employee representative, designate working days off in place of annual leave.
