Tax basics for foreigners in Korea: year-end settlement, the May income tax return and the 19% flat rate for foreign employees
Last checked: 21 October 2026 · compared against 6 official sources opened that day
Foreign employees in Korea have income tax withheld every month, then square the year at the year-end settlement. Some must also file a return in May, and some can choose a 19% flat rate. We checked the Income Tax Act and Decree, Article 18-2 of the Restriction of Special Taxation Act, the Restriction of Special Local Taxation Act and the National Tax Service (NTS) English guide to the 2026 filing season on 21 October 2026. For your own situation, ask the tax office or NTS.
Residents and non-residents
Article 1-2 of the Income Tax Act treats anyone with a domicile in Korea, or a residence here for 183 days or more, as a resident; everyone else is a non-resident. Under Article 4 of the Decree, days count from the day after you arrive to the day you leave, and 183 days within one tax year is enough; clearly temporary trips, such as holidays or medical treatment, can count as days in Korea. Residents are taxed on worldwide income, non-residents on Korean-source income.
Basic rates of 6% to 45%
Residents pay progressive rates under Article 55: 6% up to 14 million won of taxable income, 15% to 50 million, 24% to 88 million, 35% to 150 million, then 38%, 40% and 42%, and 45% above 1 billion won, each applied only to the slice in that band. Taxable income is pay minus the employment income deduction and personal and other deductions, which is why dependants and receipts change the final bill.
Year-end settlement in February
Under Article 137, your employer recalculates the year's tax when paying February's salary, or your last salary if you leave. You get back any overpayment or pay the difference; amounts over 100,000 won can be spread over the February to April salaries. If you do not submit a deduction form, only your own basic deduction and the standard tax credit are applied, so hand in your forms and receipts on time. We could not confirm from official sources which documents are needed for dependants living abroad; ask your employer or tax office.
The May return: who must file
Article 70 sets the filing period for residents with global income as 1 to 31 May of the following year. The NTS English guide gives 1 May to 1 June 2026 for 2025 income, presumably because 31 May 2026 is a Sunday. It says employees whose only income is salary and who completed the year-end settlement do not need to file.
You should file if you have business (including rental), interest, dividend, pension or other income, or if you missed the February settlement because you resigned, and you may file to claim deductions you missed. Even with a loss or no tax due you must file if you are required to, or penalties may apply. Filing can be done on Hometax, and NTS runs an English line for foreigners on 1588-0560.
Leaving Korea
Article 74 requires a resident who must file to report that year's income by the day before departure, and, if leaving between 1 January and 31 May, the previous year's as well. Salary-only employees are settled by the employer in their final month (Article 137), so collect your last payslip and withholding receipt before you go, and keep a Korean account open long enough to receive any refund.
The 19% flat rate
Article 18-2 lets foreign executives and employees, excluding day workers, choose to pay 19% of their Korean employment income instead of the progressive rates. It applies if you first started work in Korea on or before 31 December 2026, and covers employment income for tax years ending within 20 years of that first day of work; pay from a company related to your employer by family ties or management control is excluded, unless it is a foreign-invested company that meets the Decree's tax-reduction conditions.
If you choose it, tax exemptions (except certain welfare benefits), deductions, reductions and credits no longer apply, and the income is not added to your global income. You must not hold Korean nationality at the end of the tax year, and you apply with a form at the year-end settlement or in your May return. To have 19% withheld every month, submit an application through your employer by the 10th of the month after the month worked; a withdrawal takes effect from the next tax year. Under Article 106-2 of the Restriction of Special Local Taxation Act, local income tax for flat-rate employees is one-tenth of that rate, so 1.9%.
Is the flat rate better for you?
The flat rate taxes your whole salary at 19% with no deductions, while the normal method applies rates starting at 6% to income after deductions. High earners in the upper bands often gain from the flat rate; people with modest pay or large family deductions usually do better with the normal method. The only reliable answer is to calculate both, so ask your payroll team or NTS (1588-0560) to compare, and review the choice every year. This guide is not tax advice.
